Robert Cunningham, a partner in Baker and McKenzies Chicago office, is representing Medtronic Inc., a medical technology firm, in litigation with the Internal Revenue Service over the appropriate amount of the buy-in payment under a cost sharing agreement between Medtronic and its Swiss subsidiary, Medtronic Europe SA.  The litigation challenges the Services $53.6 million increase of the buy-in payment as inconsistent with the regulations under § 482, Article 9 of the U.S.-Switzerland Tax Treaty, and the OECD transfer pricing guidelines.

Mr. Cunninghams practice principally involves counseling United States and foreign multinational companies with respect to international tax planning and e-commerce transactions, including structuring worldwide operations and intercompany pricing.  He is also involved in representing companies in administrative actions and litigation in U.S. and non-U.S. income tax controversies.
